The mousepad looks like bootleg merchandice to me... you know? The kind that you find being sold right in the open in Middle-Eastern countries? Next to all the pirated and hacked games?

The mouse pad inparticular looks like it was thrown together in MS Paint. If you really want a Monkey Island mouse pad, I'm sure you can find some nice artwork and find a website that will custom print them for you.
These fanjobs are usually pretty low quality, if you're honestly looking to buy something like that and aren't just shamelessly plugging your eBay pages, then I'd recommend avoiding them.
Hm, the mousepad doesn't look too great indeed, with the distorted picture on the right hand side. I'd rather make my own design and have it printed on a mousepad at the local copy shop.

I'm not sure. It seems very easy to sue someone in the USA for big amount of money.. But I don't live over there, so I'm not really right person to speak about that.
Anyway, I don't think that either Lucas Arts or Telltale will ever waste any money or time to sue a single person who doesn't earn much bucks at all. A warning would be fine I guess. It doesn't really strengthen a company's rumour or image either, if they sue little people..
Most of the time companies take legal action as otherwise they lose rights on said trademarks and things like that. Copyright law is very complex.
Isn't that more for trademarks, specifically names, such as "Kleenex"? I don't think there's actually a case where a person lost the rights to something like producing mousepads for an intellectual property you own. Please correct me if I'm wrong on that, though I've only seen it applied to unprotected names.

Now, in this case, a hack is obviously selling cheaply-produced merchandise to make a profit off a recent release. It's crap quality, I'm sure they know it, and I'm pretty sure they're less fans and more your common bootlegger. This reeks of a quick-cash bootlegging scheme.
Isn't there a problem that the cans with the grog; and therefore also the machine, would be melten by the way? How is that solved? I could only imagine the cost of the material that must be used to enclose the liquid! :O
