Unfortunately a fix will not be coming in the next few days. If you'd like to inquire about a refund, you will need to contact Microsoft's Xbox Support.
MattP, I understand that to release a patch, at least with the Xbox it'll take time to get it all certified etc.. but can you confirm that a patch fix is planned for the future?
I just purchased the next 2 episodes as I was planning to anyway so hopefully this bug won't affect me next time I start up, but I have been recommending the game to friends who will be taking it an episode at a time and I want their experience to be as good as mine has right up until this bug.
We are hoping to find a permanent solution to this issue, but at this time we are still investigating the cause. Once we determine the cause, I can give you more accurate information regarding a fix.
Thanks Matt for the support and fix! Although I like buying the episodes as I play them, at least theres a way around this game breaking bug. I've been having the #9 switch problem, but I've also noticed that if I try to view the "Engine Start Sheet" after the initial look at it, its impossible to get away from the clipboard view and a game restart is required. Its odd because the camera will swap back to the 3rd person view of Lee, but his model will flash every time the B button is pushed, and the clipboard will disappear for a fraction of a second and then come back. Another (non game breaking) bug is that for some reason the audio will stutter at the beginning of every sentence. Currently I only have episodes 1-3, but I will be buying #4 so I can continue, thanks!
Thanks for the workaround i'll give it a go when I get the chance.
I want to recommend this to my brother but i will wait till the game is working properly again.
KeyBlader, please make sure you restart your xbox console. We have confirmed that this is a required step after installing the new episode.
Boy, thanks for the help Matt . . . I restarted, and it eliminated all Episode 3 progress FOR THE SIXTH TIME. I now have to play through the entire first half of 3 again, to most likely get stuck at the train again.
What is the problem over there? Why does your game erase saves with such astonishing regularity? I've never experienced anything like this at all . . . Just totally broken, useless. Where do my saves go exactly? Why does pressing continue on Episode 3 result in me starting a new game from Episode 1? Why must I then manually restart 3 from the beginning?
WHERE ARE MY SAVES? Where is my game? Give me my dang money back, or give me a working product, for the love of everything holy . . .
The issue you are describing was patched with the Title Update released last weekend. please ensure you acquire this Title Update, and you should no longer experience an issue with Episode 1 restarting when loading saves from other episodes.

No it didn't. How many times are you going to paste that same response before you believe us? I've been playing since Tuesday, I've never played without the update.
You need to fix your broken game instead of just regurgitating the same PR junk over and over.
Can you please let me know what type of xbox you have, if you are playing online (xbox live), what episodes you have installed, how many save slots you've used, and what your progress is in each save slot? Also, can you please provide me with a quick description of what steps you went through before losing your saves?

I have a brand new xbox 360, 250gb, connected by Ethernet cable. You do not have to fake like you don't know what we are talking about, I've read all your posts, and all the threads. You know exactly what we are talking about.
I have slot 1 saved with progress up until the walker in the car outside the train. I exit the game and turn off the Xbox. I turn it on later, choose slot 1 (where my save says today's date, and Episode 3), and move to the Episode 3 screen. The options are continue, and rewind. I choose continue, the screen goes black, and the title screen for Episode 1 starts. After cursing, I back out, choose my save (which now says Episode 1), choose Episode 3 (continue is replaced by play, and rewind has disappeared), choose play, and Episode 3 begins. This sequence has played out this way 6 times now.
Where are my saves? I left Lilly behind. Where is that information now stored? I am not doing anything weird with your game, and this is NOT OUR FAULT. Your patch has not fixed this problem. I have never played without the patch.
I am just flabbergasted that your company would give such facile response and excuses for what is, quite simply, the most catastrophically bugged game I have EVER PLAYED. I was telling people how great this game was not three days ago, and tomorrow morning I'm going to file a formal fraud complaint with Xbox Live. How's that for a turn around?
Either patch this (A), fix it (B), or give us our money back (Y). Or, you can always just press X, stay silent, and cement your burgeoning reputation as a do-nothing rip-off operation. This game is based on your choices . . .
I had the exact same bug in my game. Jumped on the forums for a workaround, found the "download next episode" theory, then downloaded episode 4, turned off 360, turned it back on and the bug was fixed. I could start the train and finish the episode. Not the preferred way to go about it..but it got the job done, so I could continue playing.
I just registered to tell you all that I have all 5 episodes Downloaded and installed and I still had the issues and restarting didn't help.
But after awhile I decided to talk to Kenny in the train and after exhausting all my conversation options I tried panel 9 again and it magically worked without having to restart or anything. I hope this helps some of you out there.
I just redownloaded episodes 4 and 5 and restarted my console and still had the issues.
I restart from the save when you're fighting the walker in the car. I get the animal cookies, talk to Kenny and still doesn't give me the option to hit the switch on panel 9.
UPDATE : Alright. Thankfully I had another save right when you arrive to the train. After doing everything, it FINALLY worked.
If your most recent save is not the beginning of the scene (such as fighting the walker in the car), then you can rewind to the beginning of the scene through the rewind menu.
Matt,
I'm also having the same problem. I downloaded, and played each episode, as I beat them. Today while playing episode 3 I got to the part where you're supposed to use the pencil on the engine instructions. Once I did that, my game glitched and I was unable to move my character, and the bottom right of my screen kept saying "B Back," as if I was still reading the engine instructions when I wasn't. The only way I am able to get out of this weird glitch is to click to use the buttons 6 and 5 alongside the train wall. Once I do that, and I move all the buttons in place, I am able to physically move my character and the "B back" command goes away. However, like everyone else, switch 9 to start the train isn't an option. I can use it BEFORE the notepad glitch, not after.
I think it's rather ridiculous that the only solution you're offering is for me to download episode 4 and 5, when X-Box specifically says "NO REFUNDS." So you're asking me to gamble $10, on a fix that may or may not work?!
I do understand your concerns, and want to assure you that we have tested to make sure these episodes will resolve the issue. I would like to reiterate that you only need episode 4 or 5 or both. However, this is only a workaround and we are still looking into this issue and hopefully will have a solution soon.
We undertand you are working in a patch, but you cant say to us that we can "fix" it if we bought episodes 4 and 5. Can you say us thats episdes dont has this kind of bug (i mean, the "i cant play the game i purchase")? I think you cant, considering the actual situation.
Telltale HAS to compensate the gamers, Xbox Live support dont do anything wrong, i use my point, they get me my game, is YOURS game that dont work.
So Matt, the winners of the game of the year just gonna ingore us?

What Matt is saying is that if you purchase and download episode 4 or 5, it acts as a workaround for this bug. If you don't want to buy episode 4 or 5, you can wait for the patch, which is being worked on now. You're not being ignored, as you already acknowledged that Telltale is working on the patch.
The problem has to be pinned down in the code (and with hundreds of thousands of lines of code in a program, this process takes a while), a patch needs to be coded, that patch needs to be sent to Microsoft, where it needs to be approved by Microsoft, and then Microsoft has to release it on their server. The Telltale team is working on the problem, please be patient as the process isn't immediate.
So, this same thing happened with me - the use icon not appearing over switch 9, and the notepad glitch as described in this thread. I downloaded episodes 4 and 5 in good faith that this would work, and restarted my Xbox. My save was deleted. So, being a complete idiot, I tried playing through episodes 1-2 again. And guess what? When I finished episode 2, and tried to continue onto episode 3, it just dumped me back at the start of episode 1 and rewrote my save. Again. Where do I go from here? Do I play through, AGAIN, in the hope that I might finally be able to play the game that I paid for?
What gives, Telltale? You've put out an obviously broken game, and don't really seem to care about fixing it. Why would you? You have our money, right?

Try the suggestions made in this thread. If that works for you, you should be able to continue from the start of episode 3.
I experienced the same problems as described in this thread. I was not able to hit the number 9 switch. I tried to download the next episode (finding this a very weird workaround) but it erased my savegame. I even tried the savegame copying workaround but it didn't retrieve my progress.
As I find this absolutely unacceptable I will be filing a complaint with Microsoft.
As you won 'The Game of The Year Award' for this game a lot of people will be buying this game. You should add a warning to your website:'You might experience problems completing this game!'
Try the suggestions made in this thread. If that works for you, you should be able to continue from the start of episode 3.
I'm not entirely hopeful, but I'll give it a try. For some reason, my stats from Episode two have been wiped (although I can still bring up the stats menu by hitting Y when selecting a level, so somewhere the game knows I've completed it, but it just brings up blank red bars), but the stats from from Episode one are still there and I believe are fine. Any word on what this issue is? I haven't seen anyone else mention it and wonder if it might be related.
To all those who find it unacceptable that a bug of such magnitude could've found it's way into the production version of the game, you'll be glad to know that Microsoft will refund your points. As they just have for me.
Try the suggestions made in this thread. If that works for you, you should be able to continue from the start of episode 3.
That workaround appeared to work (although I had to copy the file twice for some reason), and I was able to restart episode 3. However, next time I launched the game it reset me to episode 1 AGAIN, but luckily this time I had kept a backup save just in case. After overwriting the reset save with my backup it worked fine. The Switch 9 bug is now completely gone, but unfortunately I've come up against another bug. After cutting Clementine's hair, the camera flips out and cuts to the outside of the train, and I can't seem to do anything about this. I can move the camera left and right slightly, as it would if Lee were walking around inside the train, but it's just... outside the train. There are no use icons appearing anywhere.
While it's relieving to finally solve one bug which had me wasting hours on it, the fact that there's another one so soon after is pretty annoying.

I've not heard about this one, although I've experienced weird bugs like that in the past in other games. In my case they were just one time things, which were resolved by playing the section over. Try rewinding the game to the section just before that one and try playing through again. Hopefully that will work for you.

It kept happening, until one time I didn't pick up the whiskey bottle before I cut Clem's hair. That's a weird one. Didn't experience anymore bugs, apart from the one where it resets me to episode one every time I launch the game, but luckily I keep a backup save now so I can work round it, though it's still very annoying.
Hey Matt I just want you guys to be aware that after encountering the same bug I went and bought Episode 4 per your suggestion. I don't actually know if it worked because when I went to replay the mission my game save data had been reset. I know that's not a huge deal but its really frustrating to have to start all the way back at the beginning after spending more money on this game. I'm sure ill get back to it eventually but right now I'm still really irked at the whole situation.
... posts and threads on the matter of switch nine being snarky. I did have the other glitch with the notepad and not being able to move after looking at it in the room with Kenny. I did the whole episode 3 up to this point about 10 different ways literally and it was for not. I went and downloaded the episode 4 and got a real case of the arse from my wife about they just got game of the year from the VGAs and such and wont be around to help ya now that the accolades are giving out and etc ..... She is a passionate gamer and is adamant about getting what we buy and not the glitched=broken merch. I am more forgiving and would be buying episode 4 as soon as I finished 3 anywho so that doesn't make me as my wife states "a sucker". I'll update in a minute when its done wonloading and letcha know what the deal is, folks. Whether I sit with the ones who had positive resolve or stand and shout with the ones who still got negative effects.
I have encountered the same glitch regarding switch 9 (and the notepad, but I can get around that). In reliance on Matt's assurances regarding the fix, I purchased and downloaded Episode 4. That did not fix the glitch for me. I'm glad I only wasted $20 on this game. It was a relatively cheap lesson to learn to NEVER deal with telltale games again.
I am having the exact same problem as everyone else. I set everything right with panel 6 and 5. I go to panel 9 and I have no cursor to activate it. I've replayed this multiple times and did rewind.
Not only is that a problem, but the notepad as well. After using the pencil and seeing how to start up the train, if I try to look at the notepad again, it glitches when I try to back out. I'd go to main menu and try to start up the game again, but it freezes and I have to hard boot my Xbox.
So switch 9 and the notepad have been a problem for me all night as I've been trying to find ways around it and I am completely unable to play now. =\
I am having the exact same problem as well, I rewind, quit the game, choose different options, did things in different orders and it still hasn't let me flip the switch or use the note pad properly. All in all, Ive redone this part a total of 7 times.

This was an issue that was reported on PS3 when Episode 3 first launched and we found that a quick restart from your last savepoint resolved the issue. I'm not sure why you had a different experience until you did not pick up the whiskey bottle, but we will look into that.
For anyone who does purchase Episode 4 to workaround this issue, please note that there are several save points in this scene. If you have reached another save since the beginning of the scene (when the group first pulls up to the tracks in the RV), then please use the rewind menu to rewind to the beginning of this scene before continuing your progress. Furthermore, make sure you completely turn off your xbox after downloading and installing episode 4.
Also, we have pushed a patch for this through Microsoft, and it did become available today. I apologize for the short notice, as we did not expect such a quick turnaround.

Seems like for most people it's working. I don't know what else to do. I wasn't able to try it last night, so I'll try it today and see if it works.
Also, I have three saves on episode 3. Just in case my save file gets deleted like yours I have two more save files in the same spot.
