It was risky and shouldn't have been waving a loaded gun no matter what in a person face unless their an enemy and threatening your own life somehow so you must be punished. If you rob a bank and accidentally shoot and kill a hostage. Regardless of how shitty the bank looks and regardless of if you had no intentions of killing a hostage. You must be punished by being charged in a court of law for causing the death of an innocent. Marlon was far from innocent and Eli was innocent far as killing concerned. Marlon did his crimes then when he knew he fucked up and couldn't win then he just wanted to be let go and shown mercy from Clem and the group. That don't fly in the world. As Rick Grimes once said in the comic "You kill you die" So AJ in a ways was just carrying out capital punishment justice for Brody. For all we know Marlon was just having crocodile tears to be let go and wasn't sorry for shit. He looks like he could do that if he's capable of lying ? and pinning a homicide on someone else.
Clem's "accident" was not really and accident. She aimed that gun directly at a man's head and pulled the trigger and why? To scare him right? Maybe the writing wasn't so shit after all and they purposely wanted to show how stupid, mean and far gone Clem's mind had slipped at that time. Clem had much more malicious intentions than AJ. She obviously didn't care if all was duds or not and it shows afterwards with her lying her way out of taking responsibility for Eli's death who was more innocent than Marlon by a long shot. If Marlon didn't pull all the insane stunts he did in the basement and ultimately the yard then AJ would have no reason to shoot him. Marlon earned his death Eli did not. Clem killed a man that was no threat. AJ killed a teen who was a threat and a potential future threat.

We know this because of the "13 months later" flash card during the with Jane flashbacks. He's still looking like a newborn when Clem is with Jane in Howe's, even before Jane kills herself, then 13 months later pops up and she's walking through the woods, alone. AJ had just been taken from her. We also know that David gave AJ to Lingard that winter and told him to do what he needed to save the kid, which is when Lingard sent AJ to the ranch. We know it was that winter because Clem's model doesn't change between the flashbacks when she met Ava and lost AJ and "current" time in the game meaning it can't have been all that long ago.
