Naw, Max is definitely has some decency about him, even if his thuggish exterior makes it not so relevant at times. It's also pretty clear that he went along with the raids primarily because Joan convinced him it was necessary benefited Richmond and he has a silent moment with David outside the hospital that makes it clear he really does want to make things right.
I doubt he was actually trying to kill David there, especially since he was at near pointblank range. He was likely trying to distract them so he, Lonnie, and Badger could split up and make a break for it while they're distracted.
